Analysis of the Universal Declaration of Human Rights. When you think of Human Rights violations do you think of westernised countries?

Today is Human Rights Day. It happens every year on December 10. It is on this day way back in 1948 that the United Nations General Assembly adopted the Universal Declaration of Human Rights. If you have a look at the page for Human Rights Day on the UN web site it “calls on everyone to stand up for someone’s rights!”

Actually while I’m at it, here’s the entire passage;

“This year, Human Rights Day calls on everyone to stand up for someone’s rights! Disrespect for basic human rights continues to be wide-spread in all parts of the globe. Extremist movements subject people to horrific violence. Messages of intolerance and hatred prey on our fears. Humane values are under attack.”

What do you think of when you read that? What kind of imagery does it conjure up? I’d bet that you’re not thinking of anything that could happen her in Australia are you? Or any other first world country for that matter. Do you even know what the Universal Declaration of Human Rights is and more importantly, what is written in it? I’ll admit, until a couple of years ago, I didn’t. Then I looked them up. Thought it would be in my best interest to know what they were all about an what my rights as well as everyone else.

I was surprised by some of the rights listed, while others were more obvious. One thing was clear, you didn’t have to look as far away as third world countries to see violations of human rights, albeit not on the same scale. For instance;

Article 1

All human beings are born free and equal in dignity and rights. They are endowed with reason and conscience and should act towards one another in a spirit of brotherhood.

This one is no surprise really, however I’m sure there’s a whole lot of parents out there violating the “born free” bit. Actually at what age does our law state that you are your own legal entity and can make all of your own decisions?

Article 4

No one shall be held in slavery or servitude; slavery and the slave trade shall be prohibited in all their forms.

Again, pretty much expected. Someone should take a copy of this to the banks of the world and remind them…

Article 9

No one shall be subjected to arbitrary arrest, detention or exile.

Maybe someone should remind our friends in the U.S. about this one. Seems every day there are more videos online showing authorities going against it.

Article 10

Everyone is entitled in full equality to a fair and public hearing by an independent and impartial tribunal, in the determination of his rights and obligations and of any criminal charge against him.

Hmmmmm… I wonder if anyone has had an “independent and impartial tribunal” when disputing a speeding or parking fine?

Article 12

No one shall be subjected to arbitrary interference with his privacy, family, home or correspondence, nor to attacks upon his honour and reputation. Everyone has the right to the protection of the law against such interference or attacks.

Anyone hear of Google… or Apple for that matter… Upload a video to YouTube and see how your honour and reputation is attacked.

Article 15

1. Everyone has the right to a nationality.

2. No one shall be arbitrarily deprived of his nationality nor denied the right to change his nationality.

This was one of the surprising ones. It had never even occurred to me the possibility of someone not having a nationality. I wonder if we also have the right to choose non-nationality and be citizens of Earth?

The list goes on all the way up to Article 30 and I could make snarky comments about how each of them is being violated in some small way by the great western world. However, it is Article 16 I find particularly interesting, especially if you look at the language used.

Article 16

1. Men and women of full age, without any limitation due to race, nationality or religion, have the right to marry and to found a family. They are entitled to equal rights as to marriage, during marriage and at its dissolution.

2. Marriage shall be entered into only with the free and full consent of the intending spouses.

3. The family is the natural and fundamental group unit of society and is entitled to protection by society and the State.

I’m all for equality in all it’s forms and a firm believer in equal marriage rights even though I personally don’t see the point in marriage. Going beyond mine and many other peoples beliefs, I didn’t expect to find anything about marriage equality in the Universal Declaration of Human Rights.

The language clearly used is “Men and women of full age…” This is referring to age and essentially species, as no other animal has it’s sexes classified as a men or women. Nowhere does it state that it can only be between a man and a woman.

To me, it doesn’t get any clearer. Marriage Equality is a human right!

So I ask you, the Australian Government, do you realise you are in violation of a basic human right by not allowing gay marriage?

I ask you, the Australian People, are you prepared to make a stand for equality and help make it very loud and clear to the Australian Government that they are in violation of Human Rights?

And I ask any Lawyers out there, have you got the guts to take this to the top and go to war, bringing marriage equality to all?

I bring your attention to;

Article 8

Everyone has the right to an effective remedy by the competent national tribunals for acts violating the fundamental rights granted him by the constitution or by law.

Bottom line people, knowing your rights will empower your fight!
